7. What NOT to do / compliance: HIPAA (informational only, not legal advice)

⚠ What NOT to do / compliance: HIPAA (informational only, not legal advice)

  • Do not give patient information to a vendor without a business associate contract. HHS states a business associate is an entity that performs functions or services for a covered entity involving access to protected health information (PHI), and that HIPAA generally requires a written contract that sets permitted uses, requires safeguards, breach reporting, subcontractor flow-down and return or destruction of PHI at termination. Source: https://www.hhs.gov/hipaa/for-professionals/covered-entities/sample-business-associate-agreement-provisions/index.html (verified 2026-10-15). This applies to AI scribes, AI receptionists, chat and imaging AI that touch PHI. A vendor saying "HIPAA compliant" on a pricing page is not a substitute for a signed agreement.
  • Do not paste PHI into consumer chatbots or note apps that have not signed a BAA with you. (Consequence of the HHS business associate rule above; check with your counsel.)
  • Check each vendor's own HIPAA statements and get them in writing. Examples on the pages we loaded: Ruby lists HIPAA-compliant services as available; Denti.AI states HIPAA-compliant; Freed lists an organization-wide BAA for clinic plans.
  • FDA-cleared claims are vendor statements. Overjet, Pearl and Denti.AI each state FDA clearance on their pages; ask the vendor for the clearance documents and which indications are covered. AI findings support, and do not replace, the dentist's clinical judgment.
  • Do not use AI-voiced outbound calls or texts without patient consent. The FCC's Feb 2024 ruling (FCC-24-17) says AI-generated human voices are "artificial" under the TCPA and require prior express consent. Source: https://www.fcc.gov/document/fcc-confirms-tcpa-applies-ai-technologies-generate-human-voices (2026-10-15).
  • Do not use AI to create fake reviews. FTC Operation AI Comply, Sept 25, 2024: https://www.ftc.gov/news-events/news/press-releases/2024/09/ftc-announces-crackdown-deceptive-ai-claims-schemes (2026-10-15).
  • State dental board rules vary. Informational only; consult your attorney or state dental association.
