7. What NOT to do / compliance: HIPAA (informational only, not legal advice)

⚠ What NOT to do / compliance: HIPAA (informational only, not legal advice)

  • First confirm whether HIPAA applies to you. HIPAA applies to covered entities (such as certain health care providers) and their business associates; many med spas operate differently by state and billing model. Ask counsel. (The HHS pages below describe obligations of covered entities and business associates.)
  • If you are a covered entity, you need a business associate contract with vendors that handle PHI. HHS says the HIPAA Rules generally require a written contract that limits uses and disclosures, requires safeguards and breach reporting, and requires return or destruction of PHI at termination. Source: https://www.hhs.gov/hipaa/for-professionals/covered-entities/sample-business-associate-agreement-provisions/index.html (verified 2026-10-15). A pricing-page claim such as "HIPAA compliant" (Boulevard, Pabau, Vagaro, Ruby) does not replace a signed agreement.
  • Be careful with tracking pixels and marketing scripts. HHS's OCR bulletin on online tracking technologies says tracking vendors that receive PHI can be business associates and that a cookie banner is not a valid HIPAA authorization. It also states that a federal court on June 20, 2024 vacated part of that guidance (the part about IP address plus visits to unauthenticated pages), and that HHS was evaluating next steps. Appointment-booking pages and portals can still involve PHI. Source: https://www.hhs.gov/hipaa/for-professionals/privacy/guidance/hipaa-online-tracking/index.html (content last reviewed June 26, 2024; verified 2026-10-15). Note that Boulevard lists Meta Pixel on its Premier and Prestige plans; review such tools with counsel.
  • Never fake reviews. The FTC's final rule (Aug 14, 2024) prohibits fake or false consumer reviews and testimonials, explicitly including AI-generated fake reviews, and prohibits offering incentives conditioned on positive sentiment. Source: https://www.ftc.gov/news-events/news/press-releases/2024/08/federal-trade-commission-announces-final-rule-banning-fake-reviews-testimonials (2026-10-15).
  • Consent for AI-voiced calls and texts. FCC ruling FCC-24-17 (Feb 2024) treats AI-generated human voices as "artificial" under the TCPA, requiring prior express consent. Source: https://www.fcc.gov/document/fcc-confirms-tcpa-applies-ai-technologies-generate-human-voices (2026-10-15).
  • AI should not replace licensed clinical judgment. State medical-board and supervision rules for med spas vary and were not verified in this research; see _gaps.md.

Med spa AI FAQ

What can AI do for a med spa today?

Vendor pages list AI receptionists (Zenoti), AI lead qualification (Zenoti), AI agents for calls and messages (Pabau Engage Plus), an AI marketing assistant (Vagaro Vera) and automated rebooking campaigns (Boulevard).

How much does med spa software cost?

Published examples: Boulevard Aesthetics plans $199 to $416 per month per location ($179 to $374 billed annually); Vagaro from $30 per month ($23.99 for the first 6 months). Zenoti and Pabau did not show prices on the pages checked.

Is med spa software HIPAA compliant?

Boulevard, Pabau, Vagaro and Ruby each state HIPAA-related compliance or availability on their sites. If HIPAA applies to your business, HHS says you generally need a signed business associate contract. Informational, not legal advice.

Can I use Facebook or Google tracking pixels on my med spa website?

HHS's OCR bulletin says tracking vendors that receive PHI can be business associates and a cookie banner is not a HIPAA authorization; part of that guidance was vacated by a federal court in June 2024. Ask counsel about your pages.

Can I use AI to write my reviews?

No. The FTC's final rule (August 2024) prohibits fake reviews, including AI-generated ones.
